These Terms of Service ("ToS") apply to your use of Talendary's AI recruitment platform and associated services, including any software applications and websites (collectively, "Services"). By using our Services, you agree to these ToS.

Talendary AB, a company incorporated in Sweden with its office at Birger Jarlsgatan 57, 113 56 Stockholm, Sweden and company number 559440-5127.

Registration and Access

Minimum Age

You must be at least 13 years old or the minimum age required in your country to consent to use the Services. If you are under 18, you must have your parent or legal guardian's permission to use the Services and ask them to read these Terms with you.

Registration

You must provide accurate and complete information to register for an account to use our Services. You are responsible for all activities that occur under your account and may not share your account credentials or make your account available to anyone else. If you use the Services on behalf of an entity, you must have the authority to bind that entity to these ToS.

Using Our Services

What You Can Do

Subject to your compliance with these ToS, you may access and use our Services. You must comply with all applicable laws and our guidelines.

What You Cannot Do

You may not use our Services for any illegal or harmful activities, such as:

• Using the Services in a way that infringes on anyone's rights
• Modifying or distributing any part of our Services
• Reverse engineering our Services or algorithms
• Using our Services to develop competing models

Corporate Domains

If you create an account using an email address owned by an organisation (for example, your employer), that account may be added to the organisation's business account with us, in which case we will provide notice to you so that you can help facilitate the transfer of your account (unless your organisation has already provided notice to you that it may monitor and control your account). Once your account is transferred, the organisation's administrator will be able to control your account, including being able to access Content (defined below) and restrict or remove your access to the account.

Feedback

We appreciate your feedback about our Services, but you agree that we may use it to provide, maintain, develop, and improve our Services, without compensation to you.

Subscription and Payment

Billing

Services are billed monthly. We will automatically charge the payment method you provide. You are responsible for all applicable taxes.

Cancellation

You can cancel your subscription at any time before the next billing cycle. Payments are non-refundable, except as required by law.

Termination and Suspension

We reserve the right to suspend or terminate your access to our Services if you breach these ToS or for non-payment.

Upon termination, Talendary AB will retain user data as permitted by GDPR for AI training purposes, subject to our data retention policy.

Content

Your Content

You are responsible for the data you input into our Services. You represent that you have the right to use and share this data and must comply with all applicable laws and regulations.

Ownership of Content

You retain ownership of your data. We may use your data to improve our Services, comply with the law, and maintain the safety of our platform.

Similarity of Content

Due to the nature of our Services and artificial intelligence generally, Output may not be unique and other users may receive similar output from our Services. Our assignment above does not extend to other users' output.

Our Use of Content

We can use your Content to provide, maintain, develop, and improve our Services, comply with applicable law, enforce our terms and policies and keep our Services safe.

Accuracy

Artificial intelligence and machine learning are rapidly evolving fields. We are working to improve our Services to make them more accurate, reliable, safe, and beneficial. Given the probabilistic nature of machine learning, use of our Services may in some situations give results that does not accurately reflect the truth or facts.

When you use our Services you understand and agree:

• Results may not always be accurate. You should not rely on our Services as a sole source of truth or factual information
• You must evaluate our results for accuracy and appropriateness for your use case, including using human review as appropriate, before using or sharing the result from our Services
• You must not use any results relating to a person for any purpose that could have a legal or material impact on that person, such as making credit, insurance, legal, medical, or other important decisions about them

Our IP Rights

Talendary AB owns all rights, title, and interest in the Services. Users are granted a license to use our service for its intended purpose, subject to these ToS.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS." WE DISCLAIM ALL WARRANTIES, TO THE EXTENT PERMITTED BY LAW, REGARDING THE SERVICES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES.

Governing Law

These ToS are governed by the laws of Sweden, without regard to its conflict of law provisions.

Changes to These Terms

We may update these ToS from time to time. We will provide notice of material changes. Continued use of the Services after changes constitutes acceptance of the new ToS.

General Terms

• Assignment: You may not transfer your rights under these ToS. We may assign our rights without restriction.
• Entire Agreement: These ToS constitute the entire agreement between you and Talendary AB regarding the Services.
• Trade Controls: You must comply with all trade laws. Our Services must not be used for prohibited end uses or exported to embargoed countries or entities.
• Cookie Policy: Our Services use cookies essential for operation, analytics, and functionality. By using our Services, you agree to our use of these cookies.
